Introduction
Arc membership program is governed by the following terms and conditions. It is the member's responsibility to read and understand them. If there is any conflict between what is set out in these Terms and Conditions and what a member has been told by an Arc staff member or its agents, these terms and conditions will prevail.
Every member is responsible for remaining aware of the Terms and Conditions. Every effort has been made to ensure the information provided to members in relation to Arc membership is correct but Arc is in no way responsible or liable for any inaccuracy in the information provided to members concerning the membership program.
These Terms and Conditions are effective as at the date of publication (January 2008) and Arc reserves the right to amend the Terms and Conditions of the membership program from time to time.
Arc shall use all reasonable endeavours to advise members of any such changes, but shall not be liable in any way for any failure to do so.
Definitions

Arc: Comprises Arc @ UNSW Ltd ACN No. 121 239 674, ABN No. 71 121 239 674.

Member: a person who is a current financial member.

Club member: a person who has joined Arc at the Club membership level which means they can join any affiliated Club but do not have access to the full range of benefits and services.

Benefits: any of the facilities, services or arrangements offered or available to the member during the period of membership.

Goods: all goods provided by Arc.

Services: all services provided by Arc.
-
Terms and Conditions: these Terms and Conditions as amended from time to time.

Arc Sticker: Arc's member sticker held by all financial members of the organisation.
1. GENERAL
That we have your permission to contact you with relevant information regarding the program via mail, email or SMS where nominated.
You may unsubscribe from the program at any time using the unsubscribe function on any email or SMS communication or by contacting Arc.
You have the right to view and correct or update your personal information by arrangement with Arc.
Arc may share anonymous and aggregated information with current or prospective Partners for the purposes of securing better offers for Arc membership card holders.
Some offers require Arc card holders to register as a member with third party programs. This is entirely at your discretion and in doing so you may be communicated with directly by the third party, which is no longer within the control of Arc. You have the right to unsubscribe from these programs at any time.
All offers are subject to the individual terms and conditions of the Partner and may change or be cancelled at any time without notice. Changes will be published as soon as possible on the
Arc website at www.arc.unsw.edu.au
. These can be viewed by clicking on the Partner offer under the Partner page.
Partner participants in Arc membership program can change at any time without notice.
Your Arc membership card is valid until it expires depending on the length of membership and time of purchase. You must re-register on or before the card expiration date in order to continue qualifying for benefits in the following year.
In making a purchase or accepting a Partner offer, you enter into a contract directly with the Partner concerned and not with Arc.
The amount you pay for your Arc card is non-refundable after purchase.
2. Arc Membership
Membership of Arc includes several levels:

Full membership – for UNSW students and gives access to all benefits and services as promoted in each year’s memberships’ listings.

Postgraduate membership – Full membership for Postgraduate UNSW students and gives access to all benefits and services as promoted in each year’s memberships’ listings.2.

Staff membership – for UNSW staff and gives access to all benefits and services as promoted in each year’s memberships’ listings.

Associate membership – for people who are neither UNSW staff nor students but are still able to gain access to most benefits and services as promoted in each year’s memberships’ listings. Associate members do not have the right to vote & do not have access to Arc grants.

Club membership – for individuals who choose to join Arc to gain access to membership of Arc clubs and societies. These members do not gain access to the full range of benefits and services. If they choose to become a full member at a later date, the cost of becoming a club member will be discounted from the cost of a full membership. Membership cost is calculated per the number of clubs they choose to join.

Study abroad and exchange membership – these are only available to study abroad and exchange students who must show proof of enrolment status. This gives access to all benefits and services as promoted in each year’s memberships’ listings.
If a student is due to graduate half-way through the year they must take up a full membership and upon graduation can receive a refund or cancel their direct debit payments. Proof of graduation must be presented to Arc membership officers.
3. MEMBERSHIP REGISTRATION
If purchasing via the website you must collect your membership sticker in person at The Blockhouse, COFA or Arc membership registration points. If purchasing at The Blockhouse or at other designated sites, you will be issued your Arc member sticker on site.
Member stickers must be attached to a valid UNSW student card to be valid. Stickers that have been removed from the UNSW student card will be considered void. This is to minimise the risk of unauthorised use of your sticker.
The sticker is non-transferable and cannot be used by another person, even if that person has your authority to do so.
You must hold an Arc membership sticker in order to enjoy the benefits of the Benefits Program. Arc financial members may be required to show their sticker as proof of membership. A valid and appropriately designated sticker shall be considered to be proof of membership for those eligible for Arc membership.
Associate members will receive an Arc Card as well as an Arc sticker. You will have your photograph taken. Your card will then be processed and printed with your photograph on the card.

4. STICKER USE
All Arc members are entitled to obtain any applicable discounts for goods or services upon presentation of their Arc sticker. Discounts are not available under any circumstances except upon presentation of a valid sticker. Stickers must be presented at the time of purchase or entry.
Entry into an event is subject to the terms and conditions that apply to that particular event (including any imposed by the promoter of that event or the venue owner). Possession of an Arc sticker does not automatically admit an Arc Member into that event.
You may only use your membership for your own benefit. You may not transfer your Arc membership, or lend, or otherwise give your membership to another person for their use.
Arc reserves the right to cancel your membership and/or your membership in the Benefits Program in the event of unauthorised use.
Your Arc sticker may be used as proof of Arc membership. Arc reserves the right to deny access to goods and services until membership status is checked on the membership database.
5. LOST, STOLEN OR DAMAGED CARDS
It is your responsibility to take care of your Arc sticker and keep it (and your ID number) secure. You must notify Arc promptly if your Arc card is lost, stolen or damaged.
Arc will replace membership stickers if your UNSW student card is lost, or stolen, but will charge a fee for doing so, regardless of the circumstances.

6. WELCOME PACK AND COMPONENTS
Arc welcome pack is available for the first 7,000 members.
Unless the welcome pack is given to you at the point of purchase you can collect your welcome pack from The Blockhouse by presenting the Tax invoice issued at the point of purchase.
Strictly one welcome pack per Arc cardholder (subject to availability of promotion stock).
Any cardholder who tampers with the welcome pack process or who attempts to collect more than one welcome pack is disqualified immediately.
Welcome packs are available strictly only while stocks last and are issued on a first come first serve basis.
Previous Arc membership will determine which membership pack members receive. Renewing members will receive an exclusive pack designed for previous members. New members will receive the membership pack until stocks last.
Arc is not liable if any membership pack is lost, stolen, damaged or tampered with in any way. Membership pack offers may change or be cancelled at any time without notice.
Arc makes every effort to ensure that the Membership pack material is up to date and accurate at the time of printing, but accepts no liability for any direct or indirect loss or damage arising from use of or reliance on that information, even if it is inaccurate or out of date. Membership packs cannot be transferred or exchanged under any circumstances.
Membership pack value is calculated on the estimated retail dollar value relating to each item offered.
7. CANCELLATIONS AND REFUNDS
The amount paid for your membership is non-refundable and non-transferable after purchase. We recommend that you take this into account before purchasing Arc membership.
No refunds will be given on purchased Arc membership except for students who withdraw from their studies at the University of New South Wales (UNSW) up to 31 March of each year or 31 August (2nd semester). The student must provide documented evidence of their status of enrolment.* by the 31 March or 31 August (2nd Semester) each year to be eligible for a refund.
In the above-mentioned circumstances a cancellation fee of $60 applies with the remainder of the membership fee issued as a refund. The Arc Membership sticker and all diary vouchers must be returned upon cancellation of Arc membership. Failure to produce the Arc membership sticker and all diary vouchers upon cancellation will void any applicable refunds.
Any withdrawal (including graduation) after 31 March or 31 August (2nd Semester) will incur a pro-rata cost based on the one semester fee. The student must provide documented evidence of their status of enrolment* to be eligible for a refund. The Arc Membership sticker and all diary vouchers must be returned upon cancellation of Arc membership. Failure to produce the Arc membership sticker and all diary vouchers upon cancellation will void any applicable refunds.
* Documented evidence includes:
Valid UNSW Withdrawal form
Valid UNSW certificate of graduation
8. DEFERRAL OF MEMBERSHIP
Arc membership is deferrable for students with approved leave of absence from studies at UNSW or commencing an overseas exchange program affiliated with UNSW.
Arc membership will be suspended upon request of deferral for a leave of absence or overseas exchange and reactivated when the member recommences studies at UNSW. The student must provide documented evidence from UNSW of their status of enrolment*to be eligible for deferral of membership.
Deferral of membership will be only be authorised in yearly blocks, other pro rata deferrals will not be accepted.
Refunds will be given for deferral of membership to cover if the student defers Semester 2.
It is the responsibility of the member to inform Arc of the dates membership is to be suspended and to recommence.
* Documented evidence includes:
Valid UNSW leave of absence or overseas exchange form
9. INFORMATION AND PRIVACY
Arc may use your personal information to keep you informed of special promotions, events, discounts and free offers. You will be contacted via email and/or SMS where applicable and optioned. You may opt out of these communications paths at any time.
You may access the personal information you have provided to Arc by emailing Arc (
membership@arc.unsw.edu.au
) and arranging a suitable time to do so.
Your personal information will NOT be disclosed to any third party, and will not be used by parties other than staff of Arc, without first obtaining your express permission.
Arc will take all reasonable steps to ensure your personal information is protected from unauthorised access, misuse, modification and disclosure while stored or transmitted by us.
If Arc already holds any personal information about you, this is because it was obtained from one of the Legacy organisations that formed Arc or by other means of authorisation.
Arc will use your de-identified information for the purposes of planning, research, marketing and product and service development as the organisation aims to keep its services and activities relevant and inspiring.

10. DIRECT DEBIT ARRANGEMENT CONDITIONS
These Direct Debit Conditions apply to you if you agree to pay us by either:

direct debit from your bank, credit union or building society account; or
-
automatic payment from your credit card,(collectively referred to herein as an “Direct Debit Payment Arrangement”).
Arc’s commitment to you
We may change the terms of the Direct Debit Payment Arrangement at any time but will give you at least 14 days notice before we do so.
We will keep information relating to your nominated financial institution account, or credit card account, confidential, except where permitted by law or required for conducting direct debits or processing credit card payments with your financial institution or credit card provider and for a related query, dispute or claim.
We will take reasonable steps to protect personal information held by us against loss and against access, use, modification or disclosure that is unauthorised.
Each direct debit payment will occur on the due date notified to you or if that day is a Saturday, Sunday or public holiday, the next following business day. If unsure, ask your financial institution or credit card provider for details.
Your rights
Subject to the terms and conditions of your Arc membership you may terminate your Direct Debit Payment Arrangement at any time by giving notice to us at least 14 days before the due date of the next direct debit payment or direct debit transaction.
If you request to terminate your Direct Debit Payment Agreement the residual amount owing to Arc for membership is payable immediately and subject to the Arc’s cancellation terms and conditions.
If you join Arc after the first scheduled direct debit payments are due, a pro rata ‘catch up fee’ is payable. The fee payable is the pro rata amount based on the time lapsed from the beginning of the year or semester (for semester based memberships only).
You may request changes to the payment amount and/or frequency of the Direct Debit Payment Agreement transactions by providing us with notice at least 14 days before the due date of the next direct debit transaction.
Where you consider that a direct debit has been transacted incorrectly (outside the Direct Debit Payment Arrangements) you should contact us immediately on (02) 9385 7700.
Your commitment to Arc
f you cancel your Arc membership as outlined in the Terms and Conditions, your Direct Debit Payment Arrangement will terminate.
It is your responsibility to:

ensure your nominated account can accept direct debits through the Bulk Electronic Clearing System (if unsure, ask your financial institution, as direct debit arrangements are not available on some accounts) or your nominated credit card is current and valid and the credit card details and cardholder’s name are accurate;
-
Ensure there are sufficient clear funds in your nominated account, or credit available on your nominated credit card, to meet the direct debit payment on the due date. Arc will not accept any bank charges levied by your financial institution for rejected transactions in your nominated account;

Advise us if your nominated account is transferred or closed, or the account details change, and for your nominated credit card, advise us of changes to the card details you provided to us, including expiry or suspension or cancellation of your card;

Ensure that the authorisation given by you to draw on your nominated account is identical to the account signing instructions held by the Financial Institution where your account is based;

Contact us and arrange a suitable alternative payment method if the Direct Debit Payment Agreement is cancelled either by you or by the Financial Institution where your nominated account is based;

We may cancel the Direct Debit Payment Arrangement at any time or if two consecutive direct debit payments are dishonoured by your financial institution or credit card issuer, in which case you must arrange with us an alternative payment method;

If the membership fee continues to remain outstanding for two consecutive direct debit payments, the Member’s account will be forwarded to Arc’s debt recovery agency for further action. Arc shall then be entitled to charge the Member for all expenses incurred in relation to the collection of any fees and charges which shall include but not be limited to the debt collection agency’s fees, legal costs and disbursements.
