Arc @ UNSW VOLUNTEERING TERMS & CONDITIONS
Arc @ UNSW Ltd. (“Arc”), is a not-for-profit organisation in the State of New South Wales, dedicated to enhancing the student experience at UNSW. Arc’s mission is to create an inclusive and supportive environment by offering a wide range of volunteering and social opportunities where students can engage, grow, and succeed.
By applying to participate in Arc's Volunteering Programs (the "Program"), You acknowledge and agree that successful applicants (referred to as “You” or “Volunteer/s”) are subject to the following Terms and Conditions (the “Terms”). It is your responsibility to review these Terms prior to submitting your application for this Program.
By clicking “I agree” You confirm that You understand, agree to and accept these Terms:
1. GENERAL
- You warrant that You are over the age of 18, are legally entitled to accept these Terms, and create legally binding obligations for any liability You may incur.
These Terms will remain in effect for the entire duration of your volunteer position. Arc reserves the right to amend these Terms as necessary and any changes or updates will be communicated to you in writing. Your continued participation as a Volunteer signifies Your acceptance of these Terms for as long as You are engaged in the volunteer role.
You understand that nothing in these Terms or Your participation in the Program creates an employment relationship. You agree You are not an employee of Arc and that there is no expectation of money; Your involvement in the Program is based on a voluntary commitment to contribute to Arc’s mission, and you agree to perform your duties without financial, or other, compensation. You may withdraw from the Program at any time by writing to Arc.
Arc requires all Volunteers to accept a Release & Waiver of Liability form, which releases Arc from any liability or responsibility for Your health & safety; or for any loss or damage to property; or any third party’s property or persons, howsoever or when caused.
Arc may engage third party service providers to deliver goods and services connected with the Program, including but not limited to venues, ground transport operators, accommodation providers, caterers, and activity organisers. Arc does not own, operate or control these service providers, accepts no liability for the provision of such services, and makes no warranty as to their quality and standard.
Any information provided by Arc about the Program is given in good faith and is based on information available at the time. Where information is provided by a third party, Arc makes no warranties as to its accuracy.
You acknowledge that the Program is subject to a range of circumstances and conditions that may not meet Your expectations and that Arc has no reasonable control over. Accordingly, Arc is under no obligation to compensate You if You are not satisfied with any aspect of the Program irrespective of the reason.
The Program may visit public venues under conditions beyond Arc’s control, and some activities may take place at remote locations without immediate medical assistance available, or where communication, transportation or evacuation may be subject to delay.
2. VOLUNTEER OBLIGATIONS
- As a volunteer representing Arc, You are expected to maintain high standards of behaviour at all times. Your actions reflect not only on yourself, but also on Arc’s reputation and values. You agree to act with professionalism, respect, and integrity in all interactions with the UNSW community and members of the public, and adhere to the following principles:
- Respect and Inclusivity
- Treat all individuals with respect, dignity, and fairness, regardless of their background, identity, or beliefs.
- Foster an inclusive environment by valuing diversity and promoting equality.
- Ensure that all interactions, both with fellow volunteers and the community, are free of harassment, discrimination, and bullying.
- Integrity and Accountability
- Uphold honesty and transparency in all your actions and communications.
- Exercise good judgement and act in a responsible manner.
- Take responsibility for your actions, and hold yourself accountable to the standards set by Arc.
- Professionalism and Ethical Conduct
- Approach all volunteer duties with professionalism and a positive attitude. Be punctual, prepared, and dedicated to your responsibilities.
- Avoid any conduct that could bring the reputation of Arc or the Program into disrepute. This includes refraining from engaging in any illegal activities or unethical practices.
- Ensure that your actions and decisions align with the UNSW Code of Conduct, Arc’s Code of Conduct (as an affiliate) and the Arc Membership Terms and Conditions.
- Safety and Well-being
- Prioritise the safety and well-being of yourself and others during all activities. Follow all safety guidelines, instructions, and reasonable directions given by Arc staff, authorised representatives and any third-party service providers which may be involved in delivering the Program.
- Report any safety concerns, incidents, or emergencies immediately.
- Confidentiality and Privacy
- Respect the confidentiality of any sensitive information you may come across during your volunteering, including personal information about individuals or the organisation.
- Respect for Boundaries
- Be mindful of personal boundaries and respect the rights and autonomy of others at all times.
- If engaging in any form of interaction (verbal, physical, or otherwise), ensure it is appropriate, consensual, and considerate of the comfort of those involved.
- Collaboration and Teamwork
- Work collaboratively with fellow volunteers, staff members, and the community. Approach all tasks with a spirit of teamwork and mutual respect.
- Communicate effectively and respectfully, and be open to feedback and constructive criticism.
- Commitment and Reliability
- Promptly respond to all communication and reasonable requests from Arc staff or Your Program’s Officer.
- Be consistent and dependable in Your volunteering commitments. Notify the appropriate staff if you are unable to attend or complete any scheduled volunteer work.
- Follow through with any tasks or responsibilities assigned to you, and strive to make a meaningful contribution to the Program.
- Respect and Inclusivity
- Failure to meet Your obligations under these principles may result in Your termination of the Program under 4.
- You agree to return all equipment in the same condition as it was provided, undamaged and within the designated timeframe. Should you require any clarification or guidance on how to properly use any equipment, please seek instructions prior to use to ensure safe and effective handling.
- You may be required to attend mandatory induction and/or training sessions. These sessions contain vital information about the Program and is Your opportunity to ask questions. Failure to attend may result in Your removal from the Program.
- If You wish to cancel Your placement in the Program, You must inform Arc in writing as soon as possible.
- You are required to inform Arc of any medication requirements, allergies, or other medical conditions that may affect your ability to participate in the Program. Additionally, you must disclose any other limitations that could impact your health or safety during your involvement. Failure to disclose relevant information may result in Arc reviewing your suitability for the Program. Your health and safety, as well as the safety of others, are a priority, and accurate information is essential to ensure proper support and accommodations.
- You authorise Arc to contact your provided emergency contact in case of an emergency.
- You warrant that all information provided to Arc is accurate and truthful.
3. ASSUMPTION OF RISK AND WAIVER OF LIABILITY
Participation in the Program is voluntary, and You expressly assume any and all risks (whether inherent or not, and whether listed or not) associated with the Program activities which may lead to loss, injury, disability or death.
You understand that participation in the Program may involve the following risks, including but not limited to sickness, slipping, falling, allergic reactions, unaccustomed physical exertion, changes in weather conditions, inadequate supervision, travel on public or unsealed roads, failure in vehicles, equipment and facilities, collisions with natural and man-made objects, variations in terrain, the actions of other individuals and wildlife, and other events outside Arc’s control.
You, your heirs, executors, administrators, successors, and/or assigns agree to:
Release Arc, its agents and employees from any and all liability, claims and demands of whatever kind or nature, either in law or in equity, with respect to any bodily injury, personal injury, illness, death, financial loss, or property damage resulting from Your participation in the Program.
Defend, indemnify and keep indemnified Arc, its agents and employees from any and all liabilities incurred in respect of any claim or cause of action (including negligence), including legal fees and expenses of litigation, on account of any personal injury, death, loss of health, financial loss, damage to property or any other loss or damage caused or contributed to by You.
Volunteering in the Program is taken to be a Release and Waiver of Liability expressly accepting these risks and releasing Arc from liability for any property loss, personal physical or mental injury, or death caused by or during the Program.
4. TERMINATION BY Arc
Gross misconduct, use of drugs, failure to disclose a serious health concern and/or dangerous or offensive behaviour will result in immediate removal from the Program, without further notice to You.
Any other breaches of Your obligations under these Terms may result in Your removal from the Program at Arc’s absolute discretion.
Arc reserves the right to decline to accept any person as a Volunteer, or to require a Volunteer to withdraw at any time, when such action is determined by the appropriate Arc staff member to be in the best interests of the health, safety, and general welfare of You, the Program or other Volunteers.
You will be required to replace any property that is lost or damaged through Your careless or otherwise negligent behaviour.
5. PHOTOGRAPHIC RELEASE
By volunteering in the Program, You agree to being filmed or photographed which may be used for marketing or promotional purposes.
Arc reserves the right to use Your likeness in any photographs, video or audio recordings provided to Arc or taken by Arc, during or after the Program, for any legitimate purpose without further approval from You.
You agree to release Arc from any and all claims and demands arising out of or in connection with the use of Your likeness, including but not limited to, claims for invasion of privacy, defamation, or financial compensation.
Arc will not identify You by name unless specifically authorised to do so.
6. PRIVACY
You agree that the data collected in this form will be shared with the relevant Program Officers for the purposes of delivering and managing the Program. Your personal data will not be disclosed to any third parties without your consent, except where required or permitted by law.
7. OTHER
These Terms are intended to be as broad and inclusive as permitted by the laws of New South Wales, Australia, and shall be governed by and interpreted in accordance with the laws of the State of New South Wales. In the event that any term is held to be invalid by a court of competent jurisdiction, its invalidity will not otherwise affect the remaining Terms which will continue to be enforceable.
